Details of magistrate's arrest released

TARBORO — Details concerning the Edgecombe County magistrate who was charged with embezzlement last week have been released by the office of the Edgecombe County Clerk of Court.

According to the report, Kevin Smith, 40, administered bond fees from three people that totaled $2,000 and took the funds for his personal use.

The first incident reportedly occurred between May 25, 2011 and Aug. 29, 2011. Smith reportedly accessed a $1,000 bond of a defendant in a criminal case. The second case reportedly occurred between Aug. 7, 2011 and Sept. 1, 2011 when Smith reportedly accessed two $500 bonds from two people.

Smith was charged with three counts of embezzlement by state officer and was placed under a $10,000 unsecured bond.

Smith became a magistrate May 19, 1999. At that time he was 27 and was one of the youngest magistrate in North Carolina.
